Working with co-counsel, the personal injury attorneys at Abels & Annes, P.C. recently settled a case on behalf of the family of a swimming pool victim for policy limits of $500,000.
The case stemmed from an incident last year in Scottsdale with a rental property pool located in the backyard of a home. That swimming pool was not surrounded by a fence or protected by barrier alarms as required by local ordinances in the area. Because of these code violations, a young child suffered from a swimming pool accident.
The family of the victim contacted the attorneys at Abels & Annes, P.C. about this swimming pool accident to learn about their options for relief. Through our representation, we were able to identify the pool as in violation of several municipal codes and therefore as a risk to those who may be in the area, including our clients. We brought a claim on behalf of this family and against those responsible for the pool’s condition for the negligent manner in which the pool existed and we recovered a policy limits settlement of $500,000.
The Centers for Disease Control and Prevention report that ten people die every day in drowning incidents in the nation and that of those ten, two are children aged 14 years old or younger. For every child that dies in a drowning accident, another five are treated in emergency rooms for non-fatal drowning injuries. Arizona experiences a large number of the incidents due to the numerous swimming pools in the Valley and these accidents leave an impact on countless families, friends, and loved ones.
While nothing can be considered fair or adequate when a loved one is injured or loses his or her life, the laws in Arizona and in the greater Phoenix area provide certain rights that can help ease the financial burden that may come with these tragic accidents.
A typical claim for injuries or for wrongful death may be brought by a victim or the surviving family members of a victim and may seek to recover damages like medical expenses, pain and suffering, loss of companionship and lost future wages. These cases are often complex and may involve multiple defendants with multiple allegations of wrongdoing to the point that it can be difficult for family members to realize their options.
